1. If you have already filed a Replacement Claim, please remember that you must send in your computer to obtain a repair or replacement using the instructions provided to you with your replacement authorization letter.

 

2. If you are an HP/Compaq consumer and filed a claim for a replacement computer:

 

a. If you own an HP Pavilion Tx1xxx tablet computer, you may select either the Compaq Presario CQ56-115DX or an Asus EEE T101MT-EU37-BK computer as your replacement. The instructions for making this selection will be sent to you on your replacement authorization form. If you have lost this form or need assistance with making this selection, please call 1-877-440-7557.

 

b. If you own a model other than the Tx1xxx tablet computer, your computer will be replaced with a Compaq Presario CQ56-115DX notebook computer.

c. Your returned HP computer will not be returned to you, so please make sure you send in the computer identified in the Claim Form and take steps to preserve or wipe any data that you may wish to keep. You will not be asked to pay any shipping costs, but please do not send your computer anywhere until after your claim is approved and you receive shipping instructions.

 

d. If you submit a notebook computer that does not match the computer identified on your Replacement Claim Form, the Settlement Administrator will not be able to approve your claim, and you will not receive a replacement computer. If you return a computer other than the one identified in your approved Claim Form, you will be responsible for paying for return shipment within 60 days of notification of the return shipping cost, or your computer may be treated as abandoned and discarded or destroyed.

 

e. In light of the volume of claims received, replacement models are being ordered. You should receive your replacement computer 6-10 weeks from when your claim is approved. Please be patient.

 

3. If you receive a Notice of Deficient Claim, the deadline to submit your response is April 18, 2011.

 

4. If your Replacement Claim has been approved, your computer must be received by July 18, 2011.

1) Reimbursement Claims

If you previously paid to have your notebook computer repaired, you may be entitled to reimbursement of some of your costs. To help us evaluate your claim, you will be asked to provide us with certain information such as the problems that prompted the repair, the date of your repair, what was done, and how much you paid for the repair. You will also need to submit proof of payment for the repair and proof of purchase of the computer. If your computer has been previously repaired at your expense multiple times, you may total the value of these repairs and claim the sum on the Reimbursement Claim Form.

If you chose to file a claim online, don’t forget to fully complete and sign your Claim Form and include the supporting documentation or we may not be able to approve your claim.

 

2) Replacement Claims

If you would like to have your NVIDIA chip replaced or, in the case of HP/Compaq claims, your notebook computer replaced, you may file a Replacement Claim. To help us evaluate your claim, you will be asked to provide us with certain information, such as identifying serial, service tag or product identification numbers on your computer and proof of purchase of the computer. Without this information, we may not be able to approve your claim, so it is important fully complete and sign your Claim Form and include the requested supporting documentation.

If you chose to file a Replacement Claim, you will need to send your notebook computer in for processing.

 

Apple and Dell Computers

If you have an Apple or a Dell computer, your computer will need to be sent to a repair depot so that the NVIDIA GPU can be replaced. Your computer will be returned to you after the NVIDIA GPU is replaced. You will not be asked to pay any shipping costs, but please do not send your computer anywhere until you receive shipping instructions. Follow the instructions sent by the Settlement Administrator- DO NOT send your computer to a service provider or retail store.

Once you send your computer in, please note that you may be contacted by the manufacturer if your computer is in need of further repairs that are not covered by the settlement. You will be responsible for any associated charges to complete repairs that are not covered by the settlement.

 

HP/Compaq Computers

If you have an HP or Compaq notebook computer, you may be eligible to receive a replacement computer. A repair remedy is not available for HP/Compaq computers because replacement parts are not available. In light of the volume of claims received, replacement models are being ordered. The Returns Process

If the Settlement Administrator approves your claim, you will be sent a Repair/Replacement Authorization Form, and instructions for mailing your computer. Please do not send your computer anywhere until you receive that form and the mailing instructions. It is important that you follow the instructions provided, or we may not receive your computer or be able to track it for you, and we will not be able to provide you with a replacement GPU or computer.

It is strongly recommended that you mail your computer within 7 days of receiving the shipping materials and instructions to avoid delays in processing your repair or replacement. In any event, repairs or replacements will not be authorized for computers received after July 18, 2011. If your computer is not received before this date, your claim may be denied.

Follow the instructions sent by the Settlement Administrator. Please DO NOT send your computer to a service provider or retail store. Returned computers should be free of severe owner-induced damaged such as crushing, burning or malicious dismantling of components. If you are turning in an HP computer, you are responsible for removing all personal information from your personal computer prior to mailing the computer to the Settlement Administrator. The Settlement Administrator and NVIDIA are not responsible for clearing personal or other data or files from the notebook computers that are submitted, or for any damage, loss, destruction, use, or harm to such data.
